Employment Taxes

All business that withhold income taxes for their employee's paycheck are required to turn that money over to the IRS or state taxing authorities. When an employer fails to turn over the taxes withheld from the employee's paycheck, the IRS or state taxing authorities can seek recovery of those trust fund taxes from the company or anyone it deems a "responsible person". A responsible person encompasses a wide variety of people and may include directors, officers or anyone who has control over the finances of the business. These people may be held personally accountable for the business' failure to pay these trust fund taxes. The business cannot avoid paying trust fund taxes by filing for bankruptcy since the IRS will seek compensation from responsible people personally. We represent both businesses and responsible persons with trust fund issues.

Sales Taxes

Sales tax laws are very specific. Any business in the DC area may be held accountable for this tax and many, especially those providing services in the District of Columbia, do not realize it applies to them. If you are in business or considering going into business in the DC area, it is important to contact an experienced attorney to determine if you need to collect and pay sales taxes. Attorney Bruce E. Gardner can help you determine your options. If you contact the D.C. Office of Tax & Revenue before it contacts you, your voluntary compliance may result in amnesty for several of the tax years you were in non-compliance.
