A bankruptcy case is commenced by filing a petition with the U.S. Bankruptcy Court. A credit counseling class must be taken before the Bankruptcy Court will accept the petition. The petition contains various schedules in which the debtor lists assets, liabilities, monthly income, and monthly expenses.  Attorney Gardner is a member of the National Association of Consumer Bankruptcy Attorneys (NACBA).

Determining the Best Approach for You

The three basic types of bankruptcy petitions are Chapter 7, Chapter 11, and Chapter 13. Individuals can receive protection from creditors under Chapter 7 and Chapter 13 of the U.S. Bankruptcy Laws while businesses use Chapter 11 to reorganize the financial structure of the business.

In a Chapter 7 filing, a trustee is appointed to pay off all creditors by liquidating the assets of the debtor and distributing the proceeds to creditors in accordance with set priorities.

A Chapter 13 filing, allows creditors to be paid over time based on a proposed plan. Wage earners propose a plan to pay creditors in full or in part to obtain a discharge. Debtors are allowed to retain assets under a Chapter 13 and are not required to liquidate all of their assets as in a Chapter 7 filing. For example, if you own a home with equity filing under Chapter 13 may allow you to keep your home while you pay the proposed plan.
